The petitioner was arrested while travelling in Howrah-Rajendra Nagar Express Train carrying a bag containing illicit liquor, description whereof has been mentioned in the FIR.

Learned counsel for the petitioner has submitted that the petitioner is innocent and there is no allegation against him at all. The description of illicit liquor has been furnished in the FIR and the witnesses in paragraph nos. 3, 4, 5, 6, 7 and 8 have supported the occurrence.

Since the illicit liquor has been recovered from the possession of the petitioner, it is not a fit case for quashing the FIR. The application is accordingly dismissed. (Nawneet Kumar Pandey, J) HR/- U T
