JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-08-2020 Heard Mr. Binod Kumar, learned counsel for the petitioner and Mr. Uma Nath Mishra, for the State. The petitioner is in custody in connection with Barauni P.S.Case No. 105 of 2019, G.R. No. 745 of 2019 for the offences under Sections 393, 353, 307/34 IPC and Sections 25(1-b)a, 26, 27, 28 and 35 of the Arms Act pending in the Court of Sri Abinash Kumar, Judicial Magistrate,1st Class, Begusarai.

Having regard to the criminal antecedent of the petitioner, the Court is not inclined to grant bail to the petitioner. The prayer is, accordingly, rejected.

However, the court below is directed to expedite the trial and conclude the same at the earliest preferably within a

Patna High Court CR. MISC. No.22525 of 2020(2) dt.27-08-2020 2/2 period of six months from the date of receipt/production of a copy of this order.

If the trial is not concluded within the time frame as indicated hereinabove, the petitioner may renew his prayer for bail.
