JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This application, for grant of anticipatory bail, arises out of Siwan Town P.S. Case No. 516 of 2018, disclosing offences under Sections 406 and 420 of the Indian Penal Code and Section 138 of the N.I. Act.

Prosecution case is that the informant is an agent of Hindustan News Paper and was sending paper to the petitioner and for the cost of paper, the petitioner gave cheque of Rs. 50,000/- to the petitioner, which was dishonored by the bank on presentation by the informant. It further appears that vide order dated 26.07.2019, the petitioner undertook to deposit the amount in question in three installments i.e. two equal installments of Rs. 15,000/- and third installment of Rs. 20,000/- Submission of learned counsel for the petitioner is that he has already deposited Rs. 30,000/- and only Rs. 20,000/-

Patna High Court CR. MISC. No.26923 of 2019(4) dt.18-10-2019 2/2 is remained to be deposited and he undertakes to deposit the same by 14.11.2019.

Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant has not objected the same.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, surrender before the court below within six weeks from the date of receipt/production of a copy of this order along with receipt showing deposit of Rs. 20,000/- on which, the court below shall confirm the provisional bail granted to the petitioner by this court 26.07.2019.vide order dated.

Accordingly, this application is allowed.
