The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 354(B), 392/34 of the Indian Penal Code.
As per the prosecution case, allegation against petitioners is that they attempted to outrage the modesty of the complainant and took away cash of Rs. 9000/-. It is submitted that present case has been filed only with a view to save the skin from a case bearing Complaint Case No. 24 of 2022 which was filed by Ruksana Khatoon against the
Patna High Court CR. MISC. No.24729 of 2022(2) dt.12-09-2022 2/2 husband of informant and others. Both parties are next door neighbours and due to previous enmity petitioners have been falsely implicated in this case. Petitioner nos. 2 and 3 have got clean antecedent.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Madhubani in connection with Complaint Case No. 238 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
