2. It is submitted by learned counsel for the petitioner that due to mistake of advocate clerk, the notice has not been filed within stipulated period of time as granted by this Hon'ble Court and the same was dismissed for default.

3. Learned counsel for the State does not oppose the prayer made on behalf of the petitioner.
