The petitioner apprehends her arrest for the offences punishable under section 307 and other allied sections of the Indian Penal Code.

The informant named the petitioner along with other accused persons and alleged that they assaulted the informant and her daughter causing injury on the nose of daughter of the informant. The petitioner is alleged to have snatched the earring from the daughter of the informant.

It is submitted that there is no specific allegation of assault against the petitioner. The police after investigation submitted final form but cognizance was taken against the petitioner.

No.51936 of 2015 (2) dt.22-12-2015 2/2 Considering the fact that there is no specific allegation of assault against the petitioner, the petitioner is a lady, she, in the event of her arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Madhepura in Shankarpur P.S. Case No. 45 of 2014, subject to the conditions as laid down in section 438 (2) of the Code of Criminal Procedure, 1973.
