JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Banmankhi P.S. Case No. 05 of 2017 registered under Sections 341, 323, 448, 353, 384, 504, 506, 427 and 379 of the Indian Penal Code.

The accusation is that the informant being the Incharge of Headmaster of Samprati Middle School Kajhi, was discharging his duty on 07.01.2017.

At about 12.00 A.M. four persons named in the F.I.R. including the petitioners came at the school and made demand of Rs. 5000/- saying that since two months they used to take Rs.2,000/- as ransom. When

No.15502 of 2017 (3) dt.20-07-2017 the informant made protest, then they started to cause assault to him and forcibly torn the register of midday meal and took away five other register giving threatening of dire consequences.. Learned counsel for the petitioners submits that petitioners are resident of the place of occurrence village and they are the members of Vigilance Committee of the said school. When some irregularities in the midday meal was detected by the vigilance committee the informant lodged the present case with false allegation only to give undue pressure. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Purnea, in connection with Banmankhi P.S. Case No. 05 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
