2. The petitioner seeks bail in a case registered for the offence punishable under Sections 303(2), 317(4), 318,(2) of the B.N.S.

3. The First Information Report has been lodged against as many as 6 persons and it has been stated that two persons namely, Sonu Kumar and Sanjit Yadav were apprehended by the police force and took the name of another person Banti Kumar who was also nabbed and upon inquiry, they admitted that they were all planning to commit theft of motorcycle. They were unable to produce the documents of the motorcycle in their possession and thus admitted that the same was also stolen one.

Learned counsel for the petitioner submits that the name of the petitioner has been disclosed by one Sonu Kumar by stating that the stolen motorcycle can also be recovered from the possession of the petitioner. It is a fact that the police has shown a recovery of a Pulsar motorcycle from the possession of the petitioner however, he has disclosed that the said motorcycle had been given to him by one Nitish Kumar after having taken money from him. Further, it has also been submitted that there is no independent witness to the seizure list. The petitioner is in custody since 12.01.2025 and the charge-sheet has already been submitted in the case. It has also been pointed out that coaccused Sanjeet Yadav, who has been named in the FIR right in the beginning and was initially nabbed by the police with the stolen motorcycle, has already been granted bail vide order dated 14.05.2025 passed in Cr. Misc. 28905 of 2025.

5. Learned APP for the State has opposed the application for bail.

Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court

(I) The petitioner shall cooperate in the investigation/trial.
