JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-10-2020 This is the second attempt of the petitioner seeking regular bail in connection with Muffasil P.S. Case No.89/2019 registered for the offence under Section 394 of the Indian Penal Code.

Earlier the prayer for regular bail of the petitioner was rejected by this Court taking note of the criminal antecedent of the petitioner as it was found that he has got at least five cases on his head of similar nature. Although this Court had made an observation that the petitioner may renew his prayer for bail after a reasonable time, but when a report has been called for by this Court with regard to the cases pending against the petitioner, the Court is almost surprised to know from the report that in Pipariya P.S. Case No.10/2015 the petitioner is named

Patna High Court CR. MISC. No.24699 of 2020(3) dt.12-10-2020 2/2 accused, but the records of the said case is still pending for appearance of all the accused including this petitioner. It shows that in the case of 2015 for five years the petitioner has been absconding. There are other cases such as Muffasil P.S. Case No.89/2019 which is fixed for evidence and Muffasil P.S. Case No.48/2019 and Begusarai Muffasil (Singhaul) P.S. Case No.24/2019 which are pending for appearance.

Considering the aforesaid aspect of the matter, this Court is of the considered opinion that release of the petitioner at this stage would not be just and proper as he is in fact absconding in the above cases and if released on bail it will be difficult to procure his appearance.

Let the trial be expedited.

This application is dismissed.

In fact it is for all these reasons that in paragraph '3' very wisely no statement has been made that the petitioner is on bail in those cases.
