The petitioner seeks pre-arrest bail in connection with Masrakh P. S. Case No. 120 of 2017 registered under Sections 363, 366-A, 341, 324, 307, 504 and 34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that the allegation of abducting the niece of the informant is against co-accused Arzoo Mian and the allegation of assault with sword upon the informant is specifically attributed against one co-accused Ish Mohammad. He submitted that since the petitioner belongs to the family of Ish
Patna High Court Cr.Misc. No.48628 of 2017 (2) dt.18-10-2017 2/2 Mohammad, he has also been named in the FIR.
Learned Additional Public Prosecutor for the State has opposed the application for grant of pre-arrest bail to the petitioner.
Considering the nature of allegation made against the petitioner as well as the fact that the co-accused Ruksana Khatoon @ Roksana Khatoon and Naseema Bibi have already been granted anticipatory bail vide order dated 22.08.2017 passed in Cr. Misc. No. 29499 of 2017, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-VII, Saran at Chapra in Masrakh P. S. Case No. 120 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
