The petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code.

The prosecution case in short is that while the informant was in the way having money with him, the accused persons surrounded him and snatched the money bag of cash and on protest, the informant was assaulted.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-11-2018. Charge sheet has already been submitted. The petitioner is not named in the FIR. His name transpired in this case in course of investigation. The

Patna High Court CR. MISC. No.21952 of 2019(2) dt.12-04-2019 2/2 miscreants committing robbery are said to be of the age between 25-30 years. The petitioner is aged about 40 years. There is no recovery of any incriminating article from possession of the petitioner. The other co-accused with similar allegation have been granted bail by this court vide order dated 13-02-2019 passed in Cr. Misc. No. 8509 of 2019.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 817 of 2018.
