KUMAR ORAL ORDER 29-09-2021 The petitioner, who is in custody since 13.07.2019, has approached this Court to renew his prayer for bail in a case registered for the offences punishable under Sections 341, 323, 324, 326, 307, 376,302,34 of the Indian Penal Code.
Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 05.06.2020 passed in Cr. Misc. No. 85670 of 2019.
Petitioner is alleged to have assaulted victim with knife on several parts of her body, who, subsequently died during treatment. The postmortem report also corroborates the prosecution version. It is submitted by learned counsel for the petitioner that victim is aunt(Chachi) of the petitioner
Patna High Court CR. MISC. No.34138 of 2021(3) dt.29-09-2021 2/2 and in the background of some property dispute, the petitioner has been roped in the present case. Moreover, the petitioner is in custody since 13.07.2019. It appears that vide order dated 04.08.2021, a report was called for with regard to the present stage of the trial. The report has been received and it has been kept as Flag-A.
The report of the learned I/C Sub-Divisional Judicial Magistrate, Araria reflects that the case has been committed to the Court of Sessions.
Considering the fact that petitioner has inflicted several blows on the informant, who subsequently died during treatment, this Court is not inclined to renew the prayer for bail of the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
