JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-01-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners, who are Nanad and Nandosi of the deceased, are apprehending arrest in connection with Masaurhi P.S. Case No. 26 of 2020 for offences under Sections 304(B) and 201/ 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioner have no criminal antecedents. Learned counsel further submits that the petitioners have no concern with the day-to-day affairs of Naihar and Sasural and therefore, they are not directly connected with commission of crime in the instant case.

No.22955 of 2020(3) dt.11-01-2021 2/2 Considering the fact that the petitioners are Nanad and Nandosi of the deceased and there is no specific allegation of torture and overt act against them, the Court is inclined to grant the privilege of anticipatory bail to the petitioners subject to the condition that the petitioners have to deposit Rs.50,000/- in cash. On depositing the amount of Rs.50,000/-, petitioners, above-named, in the event of arrest or surrender within one month from today, shall be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 26 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Deposit of Rs.50,000/- (Rupees fifty thousand) shall abide by final outcome of Masaurhi P.S.
