Petitioners apprehend arrest in connection with Bhagwanpur P.S. Case No.173 of 2017 registered for the offences under Sections 448, 308, 323, 504, 506 and 34 of I.P.C. It is alleged that when the informant was constructing the house, petitioner nos.2 and 3 on the order of petitioner no.1 assaulted the informant and others.
It has been submitted that these petitioners and the informant are agnates and due to land dispute between the parties the occurrence took place. There is also counter case from the side of the petitioner. The injuries allegedly sustained by the
Patna High Court Cr.Misc. No.15340 of 2018 (2) dt.09-04-2018 informant have been found simple in nature, which is annexed as Annexure-2 with this application.
The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioners, in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the likewise amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No.173 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Sanjay Kumar, J) Harish/- U
