The petitioner seeks bail in connection with Special (POCSO) Case No. 103 of 2016 for the offence under Sections 366A, 376, 34 of the Indian Penal Code and 3⁄4 of the POCSO Act.
Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, earlier the prayer for bail of this petitioner had been rejected on several occasions by the then co-ordinate Bench of this Court with an observation and direction to conclude the trial of the case within nine months from the date of order
Patna High Court CR. MISC. No.22623 of 2020(2) dt.10-09-2020 2/2 i.e.04.09.2019 but the trial of the case is still pending and there is no likelihood of conclusion of trial in near future. The petitioner is rotting in judicial custody since 01.04.2017. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned Additional Sessions Judge-I- cum- Special Judge (POCSO), Patna in connection with Special (POCSO) Case No. 103 of 2016 arising out of Naubatpur P.S.
