The present application for anticipatory bail has been filed renewing the prayer for anticipatory bail in view of the changed circumstances as the named accused of the present case namely, Md. Islam, husband of the deceased has been acquitted of the charges under Section 302 of the IPC.
It is submitted on behalf of the petitioners that after considering all facts and circumstances the husband Md. Islam was acquitted by the court of 3rd Additional Sessions Judge, Purnea in Sessions Case No. 218 of 2015, as such, now the entire circumstances have been changed as evidences which have been
Patna High Court Cr.Misc. No.28705 of 2016 (3) dt.28-09-2016 2/2 adduced during the course of the trial have not conclusively proved beyond doubt the allegation as made out in the FIR. Considering the aforementioned facts and circumstances and that the petitioners are the sister-in-laws of the deceased lady, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 281 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The judgment in Sessions Case No. 218 of 2015 is being kept on record.
