ANJANA MISHRA ORAL ORDER 05-08-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 11.02.2019 in connection with Kadwa P.S. Case No.39 of 2019 registered for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are not named in the F.I.R. However, the names of the petitioners have surfaced on the basis of the confessional statement made before the police by one Md. Zahid, which has no evidentiary value. Learned counsel further submits that there is no recovery from the petitioners and the recoveries of cash as stated are belonging to themselves,

Learned counsel for the petitioners further submits that these petitioners have no criminal antecedents and have been falsely implicated in this case. Considering the entire facts and circumstances of the case, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Kadwa P.S.
