Learned counsel for the petitioner undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 341, 323, 504, 506 and 308 of the Indian Penal Code. Petitioner is said to have assaulted the brother of the informant by means of danda on his head and gave a fist blow on his left eye.
It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this
Patna High Court CR. MISC. No.33388 of 2021(2) dt.28-01-2022 2/2 case. He submits that as per injury report Suraj Kumar has sustained injury on his head caused by stick. The opinion has been kept reserved for want of C.T. scan report. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.
Learned APP for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner of assaulting the brother of the informant by means of danda.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Kotwali P.S. Case No. 49 of 2018. (Anjani Kumar Sharan, J) devendra/- U T
