The petitioners seek anticipatory bail in connection with Gogri PS case no. 173 of 2017 dated 12.4.2017, G.R. No. 1036 of 2017 registered for the offences punishable under Sections 341, 323, 379, 308 and 34 of the Indian Penal Code. The case of the informant is that the petitioners herein had assaulted the informant.

The learned counsel for the petitioners submits that the allegation is not believable inasmuch as no injury has been caused on the person of the informant, moreover, the petitioners are having a clean antecedent.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.10547 of 2018 (2) dt.22-02-2018 2/2 case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioners above named are directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Gogri PS case no. 173 of 2017 dated 12.4.2017, G.R. No. 1036 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
