JUSTICE GOPAL PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 19-01-2015 The petitioner claims to be a resident of Bari Dhaka Village of Banka District. He filed this writ petition as a P.I.L. with a prayer to direct enquiry into the matter pertaining to distribution of drought relief, during the years 2010-11. He states that a sum of Rs.5.75 crore was released by the Government for the distribution to the persons, who are old aged, handicapped or widows, on account of drought condition prevailing in the district. He states that he made representation dated 27.09.2012 to the respondents with a prayer to
Patna High Court CWJC No.12647 of 2013 dt.19-01-2015 2/2 cause enquiry into the matter, but no steps have been taken in relation thereto.
On behalf of the respondents, a detailed counter affidavit has been filed. It is stated that beneficiaries have been selected strictly in accordance with the prescribed norms and the distribution was also made in the presence of, not only the elected representatives, but also the Government officials at the appropriate level. The allegation as to irregularities in the matter of distribution is flatly denied.
Heard Sri S. K. Jha, learned counsel for the petitioner and Sri Ray Shivaji Nath, learned A.A.G.-3 for the respondents. The matter pertains to distribution of the drought relief funds way back in the years 2010-11. Except making a vague, general and abstract allegation, the petitioner is not clear as to the nature of alleged irregularities. Not a single person has alleged that he did not receive the amount though his name was mentioned in the record.
We do not find any merit in this writ petition. Accordingly, this writ petition is dismissed. Interlocutory application, if any, shall stand disposed of. There shall be no order as to costs.
