The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 409, 420 of the Indian Penal Code.

As per the prosecution case, two F.I.R. named accused persons illegally withdrawn Rs. 13,45,594/- and Rs. 13,45,013/- respectively by committing fraud. Petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation. Petitioner is not the beneficiary of the alleged offence, which was allegedly withdrawn by those two teachers. Petitioner is a class III employee and is posted at Saharsa in the office of District Education Officer from 29.02.2020. Prior to present posting, the petitioner was posted in the office of District Education Officer,

Patna High Court CR. MISC. No.25501 of 2022(2) dt.12-09-2022 2/2 Madhepura. Similarly situated co-accused Ugresh Prasad Mandal has been granted bail by this Court, vide order dated 25.08.2022 passed in Cr.Misc. No. 16032 of 2022. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for bail of petitioner.

Considering the aforesaid facts and circumstances as well as clean antecedent, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Srinagar P.S. Case No. 16 of 2021, G.R./CIS No. 380 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
