12-02-2018 Heard Sri Gagan Deo Yadav, learned counsel for the petitioners and Sri Panchanand Pandit, learned Addl. Public Prosecutor.

Three petitioners, apprehending their arrest in Laukaha P.S. Case No. 121 of 2017 registered for offence under Section 307 & other allied sections of the Indian Penal Code, have prayed for grant of bail in the event of their arrest or surrender. Learned counsel for petitioners submits that there was case and counter case in between the parties and petitioners & informant side are gotiyas. He further submits that there is accusation of giving farsa blow against one Kamaldeo Yadav. So far as petitioners are concerned, it was submitted that there is no specific accusation. He further submits that so far as petitioner no. 2 is concerned, there is only allegation that he

Besides hearing, I have also perused the F.I.R. and after going through the same, I am of the view that there is specific accusation so far as petitioner no. 1 (Indradeo Yadav) is concerned. Accordingly, the prayer for grant of anticipatory bail in respect of petitioner no. 1 (Indradeo Yadav) is rejected. So far as petitioner no. 2 and 3 are concerned, there is no such serious accusation. Moreover, petitioner no. 3 is lady. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let petitioner no. 2 namely Harindaran Yadav @ Hari Yadav and petitioner no. 3 namely Sukani Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Jhanjharpur, Madhubani in connection with Laukaha P.S. Case No. 121 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
