Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302, 120(B),34 and other allied sections of the IPC.

As per the prosecution case, the informant suspects that his brother (petitioner) with the help of co-accused Danish, killed his wife.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on suspicion. It has been further submitted that the informant is not the eye-witness of the alleged occurrence. Petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.24751 of 2022(3) dt.14-11-2022 2/2 Learned counsel appearing for the State and informant oppose the prayer for bail and submits that the petitioner along with other accused persons committed murder of the wife of the informant in order to grab her property.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is refused with direction to the petitioner to surrender and seek regular bail, which would be disposed of on its own merit without being prejudiced by this order.
