ANJANA MISHRA ORAL ORDER 09-01-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 363/366A of the Indian Penal Code.

Diary in this case was called for earlier, which has, since been received.

After hearing learned counsel for the petitioners, and learned counsel for the State and on perusal of the materials on record, it appears that there was communication between the son of the petitioner Nos. 1 and 2. Niraj is said to have taken away the daughter of the present informant. The victim girl being the minor has not yet been recovered.

Patna High Court Cr.Misc. No.30494 of 2016 (6) dt.09-01-2017 P2/2 Considering the nature of allegations made, I am not inclined to grant anticipatory bail to petitioners No. 2 and 3. It is accordingly rejected.

However, so far as petitioner No. 1 Heeramati Devi is concerned, let the petitioner No. 1, in the event of her arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Goriakothi P.S. Case No. 17/16, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
