The petitioner apprehends his arrest in a registered for offences punishable under Sections 366(A)/34 of the Indian Penal Code.

As per allegation the petitioner has enticed the daughter of the informant and took her away for marriage. The girl, in her statement recorded under Section 164 Cr.P.C., a copy of which has been appended with the supplementary affidavit, has stated her age as 19 years whereas the court has assessed her age about 18-19 years. The girl has stated that she had voluntarily gone with the petitioner and they have married and she has never been kidnapped by the petitioner. Annexure 3, copy of the

Patna High Court Cr.Misc. No.31290 of 2016 (2) dt.11-08-2016 2/2 provisional certificate granted by the Bihar School Examination Board, indicates that the date of birth of the girl is 31st January, 1997.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Rauki Kumar @ Ajit Kumar be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Barun P.S. Case No. 68/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
