Case No. 566 of 2018 registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code and later on Section 302 IPC was added.
Prosecution story is that the petitioner caught hold of the deceased and one co-accused Md. Aslam assaulted the deceased by iron rod, causing injuries to him and later on he died.
Submission of learned counsel for the petitioner is that FIR does not disclose any allegation of assault against the petitioner and he is aged 70 years and charge has already been framed in this case and he is in custody since 9.12.2018. Heard learned APP and learned counsel for the
Patna High Court CR. MISC. No.24851 of 2019(3) dt.22-05-2019 2/2 informant, who has opposed the prayer for bail of the petitioner. In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Bihar P.S.Case No. 566 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bonds shall be cancelled.
