The petitioner seeks anticipatory bail in connection with Srinagar P.S. Case No. 08 of 2016 for the offence registered under sections 20 & 22 of the Narcotic Drugs and Psychotropic Substances Act.
The allegation is regarding recovery of 500 grams of dry ganja from the campus of the petitioner herein. The learned counsel for the petitioner submits that the provision of Section 100 Cr.P.C. has not been complied with and moreover none were present in the house when the said seizure was made. In any view of the matter, it is submitted that the said recovered ganja does not come under the commercial quantity. It
Patna High Court Cr.Misc. No.10005 of 2018 (3) dt.06-04-2018 2/2 is further submitted that the similarly situated co-accused person has been granted bail by this Court vide order dated 14.11.2017 passed in Criminal Misc. No. 47501 of 2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Madhepura in connection with Srinagar P.S. Case No. 08 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
