2. The petitioner who apprehends arrest in connection with Baikunthpur P.S. Case No. 419 of 2023 lodged on 06.12.2023, for the offences punishable under sections 413, 414/34 of the Indian Penal Code.

3. As per the prosecution, the F.I.R. has been lodged against three named accused persons, including the petitioner, alleging that they committed the theft of a motorcycle, which was subsequently recovered from the house of co-accused Raju Rai.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. It is further submitted that the petitioner has a clean antecedent. Learned counsel refers to paragraph 8 of the bail petition,

Patna High Court CR. MISC. No.27512 of 2025(2) dt.07-05-2025 2/2 wherein it is specifically stated that the mention in the F.I.R. suggesting that the petitioner, Munna Rai, and co-accused Raju Rai are members of the same family is incorrect. The petitioner and Raju Rai are merely pattidars and have been residing separately in different houses for a long time. The petitioner has no criminal antecedents.

5. Learned APP for the State opposes the prayer for bail.

In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) as mentioned in Section 2(1) (d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 to the satisfaction of the learned Judicial Magistrate, 1st Class, Gopalganj, in connection with Baikunthpur P.S. Case No. 419 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
