ANJANA PRAKASH ORAL JUDGMENT Date: 13-07-2015 The Petitioner seeks quashing of the First Information Report of Charpokhari P.S. case No.125 of 2007 pending in the court of the Chief Judicial Magistrate, Bhojpur, Ara. A counter affidavit has been filed stating therein that now charge sheet has been submitted.

It has been submitted on behalf of the Petitioner that till date no cognizance has been taken and he disputes the fact that the charge sheet has been submitted in the court below. It has also been submitted that the allegations against the Petitioner are unwarranted and malafide.

Be that as it may, since this court is not in a position to verify the claim of either party, the matter is disposed of with a direction to the court below to look into the records and see whether

Patna High Court Cr.Misc. No.46824 of 2012 dt.13-07-2015 2/2 charge sheet has been submitted and pass appropriate orders within a period of three weeks from the date of receipt of this order. With the above observations, the application stands disposed of.
