JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2019 This is an application for grant of anticipatory bail in connection with Muffasil P.S. Case No. 749 of 2018, disclosing offences under Sections 328, 302, 120B, 34 of IPC. Written report disclosed an allegation that the son of the informant has been administered poison by his wife, as she has illicit relationship with petitioner.

Submission of the learned counsel for the petitioner is that except the above fact that wife of the deceased has illicit relationship with the petitioner, no other material has come on record and as a matter of fact, he was not present at the place of occurrence at that time, rather he was at Nepal working for his livelihood.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that petitioner has illicit

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Begusarai, in connection with Muffasil P.S. Case No. 749 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
