2. Learned Advocate for the petitioner adverting to the averments made in the writ petition has contended that the father of the petitioner was superannuated on 31.01.1997, while working as a Dentist at RINPAS Kanke. On being superannuated, the father of the petitioner subsequently died on 05.12.2005 and thereafter, family pension was started in favour of the wife of the erstwhile employee, who also subsequently died in the year 2017. Now son of the erstwhile employee has approached before this Court seeking a direction for payment of remaining post retiral dues, including GPF, LIC, leave

Patna High Court CWJC No.7410 of 2024(2) dt.19-03-2025 2/3 encashment and gratuity of his father. It is also contended that the father of the petitioner has also been deprived from salary for certain period.

Referring to Annexure-2 series, learned Advocate for the petitioner further contended that time without number, several representations have been filed before all the authorities concerned, but till date, the admissible retiral benefits, as disclosed hereinabove, has not been paid, compelling him to approach this Court.

4. Learned Advocate for the State has urged that since the petitioner has already filed representation, which is pending before the authorities concerned, the present writ petition may be disposed off.

5. Considering the nature of the grievance, the writ petition stands disposed off with a liberty to the petitioner to file a fresh representation before the Principal Secretary, Health Department, Government of Bihar, Patna, preferably within a period of two weeks, from today.

6. In case such a representation is filed, the concerned respondents shall consider the same after verifying the records and ensure payment of all the admissible dues, if any, within a further period of eight weeks.

7. The writ petition stands disposed off.
