JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 The petitioner apprehends his arrest in connection with Sour Bazar P.S.Case No. 603 of 2018 registered under Sections 30(a), 38(i) and 41(1) of the Bihar Prohibition and Excise Act. Allegation is of recovery of 365 litres of foreign liquor from the pond of Md. Kasim and who disclosed the name of petitioner that he has kept liquor there.

Submission of learned counsel for the petitioner is that FIR itself disclosed that recovery is from the pond of Md. Kasim and not from the house of petitioner but on confessional statement, petitioner has falsely been implicated in this case and he is accused in one more case.

Heard learned APP also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court CR. MISC. No.22278 of 2019(2) dt.08-04-2019 2/2 privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
