====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------------- 11-12-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Kurtha (Manikpur) P.S. Case No.72 of 2015 registered under Sections 341, 323, 147, 504 and 506 of the Indian Penal Code besides Sections 3(1)(iv)(x) of the SC/ST (Prevention of Atrocities) Act and, later on, added Section 411 of the Indian Penal Code.

The allegation of the informant is that Khata No.23/62 appertaining to Plot Nos.300/334 was settled in the name of the

Patna High Court Cr.Misc. No.50880 of 2015 (2) dt.11-12-2015 2/2 informant and receipt had also been granted to him. In the light of the letter issued by the Janta Darbar of Hon'ble Chief Minister, he got possession over the said land with the help of police on 27.05.2015 but, thereafter, all the accused persons including the petitioners forcibly fixed the peg on the said land of the informant and dispossess him from the said land giving threatening of assault and committing murder.

Learned counsel for the petitioners submits that the petitioners are ladies and the co-villagers of the informant and have falsely been implicated in this case only to put undue pressure without any specific overt act.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender within four weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal (Jehanabad) in connection with Kurtha (Manikpur) P.S. Case No.72 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C. (Rajendra Kumar Mishra, J) P.S./- U T
