2. The petitioners apprehend their arrest in a case registered under Sections 126(2), 115(2), 117(2), 118(2), 74, 303(2), 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita.

3. As per prosecution case, all the accused persons including the petitioners, armed with lathi-danda and iron rod, entered in the house of the informant and it is alleged that coaccused Anil Ray assaulted the informant with iron rod due to

Patna High Court CR. MISC. No.26025 of 2026(2) dt.22-04-2026 2/3 which her right leg became fractured. Co-accused Sunil Kumar tried to outrage the modesty of the informant and petitioner no. 2 snatched gold mangalsutra from the neck of the informant.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to previous enmity and dirty village politics. Further submission is that there is no specific allegation against the petitioner of assaulting the prosecution. Specific allegation is against co-accused Anil Ray of causing injury with the iron rod on the informant. Both the parties are co-villagers. There is case and counter case between the parties. He next submits that the F.I.R. has been lodged after a delay of 5 days without any plausible explanation. Petitioner nos. 2, 3 & 4 have no criminal antecedent, whereas petitioner no. 1 has two criminal antecedents and petitioner no. 5 has one criminal antecedent, in which they are on bail. Petitioners undertake to cooperate in the investigation and trial.

5. Learned A.P.P. appearing on behalf of the State opposed the bail application.

6. Having considered the facts and circumstances of the case, submissions of learned counsel for the parties and nature of allegation against the petitioners, let the above named

No.26025 of 2026(2) dt.22-04-2026 3/3 petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur in connection with Bihta P.S. Case No. 638 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
