The petitioners are apprehending their arrest in connection with Mahua P.S. Case No. 370 of 2015 for the offences instituted under Sections 302 and 328/34 of the IPC. The prosecution story, in brief, is that the sister of the informant, namely, Rani Devi was married with Ajit Giri about 11 years ago, but since after the marriage all the accused persons as named in the FIR were torturing his sister and also used to assault her for dowry, for which a Mahua P.S. Case No. 710/2013 was lodged. On 09.07.2015, the informant received information that

Thereafter, the informant alongwith his family members went to private Clinic where treatment of his sister was going on. Thereafter she was referred to Sadar Hospital, Hajipur, and also P.M.C.H., Patna, for treatment where she died on 09.07.2015. It is further alleged that the deceased sister Rani Devi has told the informant that on demand of Rs. One Lac by people of Sasural she was assaulted and tortured by them and on protest by her on 09.07.2015 at 7.30 A.M. her mother-in-law, father-in-law, husband, Dewar and Nanad all forcibly caught hold her and Sindhu Kumar administered poison forcibly to her. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent.

The petitioner no. 1 is the father-in-law, petitioner no. 2 is the mother-in-law, petitioner no. 3 is the sister-in-law, petitioner no. 4 is married sister and petitioner no. 5 is the Dewar of the deceased. The husband of the deceased is in custody. Petitioners are separate in mess and property from the husband of the deceased.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their

Patna High Court Cr.Misc. No.52554 of 2015 (3) dt.19-02-2016 3/3 arrest or surrender before the learned court below within a period of six weeks from today in connection with Mahua P.S. Case No. 370/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
