The petitioner apprehends arrest in connection with Sitamarhi P.S. Case no. 20 of 2014 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 332, 333, 307, 353,431 and 186 of the Indian Penal Code and under Section 5/6 of the Bihar Essential Service Maintenance Act 1947. There are altogether thirty one F.I.R. named accuseds including the petitioner who allegedly formed an unlawful assembly and indulged in scuffle. They allegedly blocked the road and assaulted the students of another group.

It is submitted that one of the co-accused Ashok Kumar, Director of a Coaching Institute against whom there is allegation of abetment and leading the students has been allowed

Patna High Court Cr.Misc. No.31245 of 2017 (2) dt.18-07-2017 anticipatory bail on 03.02.2015 in Cr. Misc. no. 4468 of 2015. The allegation of assault is omnibus against the accuseds. The case of this petitioner stands on similar footing to the accused granted anticipatory bail.

Considering the facts and circumstances of the case, the prayer of anticipatory bail is allowed. The petitioner above named, in the event of arrest/surrender within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M. Sitamarhi in connection with Sitamarhi P.S. Case no. 20 of 2014, subject to the condition as laid down under Section 438(2), the code of Criminal Procedure.
