JUSTICE SHIVAJI PANDEY ORAL ORDER 25-01-2021 This case has come under the heading 'To Be Mentioned' at the instance of the petitioner. Counsel for the petitioner submits that there is apparent typographical error in the third paragraph of the order no. 4 dated 06.01.2021 as in place of 'the said staff including the seven persons have misappropriated the fund of Rs. 13,78,697/- of the Bank', 'the said staff misappropriated the fund of Rs. 3,78,697/- of the Bank' has been typed.

Let 'the said staff misappropriated the fund of Rs. 3,78,697/- of the Bank' mentioned in the third paragraph of the order dated 06.01.2021 be read as 'the said staff including the seven persons have misappropriated the fund of Rs. 13,78,697/- of the Bank''.

Similarly, the words appearing in the fourth paragraph

No.22598 of 2020(5) dt.25-01-2021 2/2 of the aforesaid order i.e. 'learned counsel for the petitioner submits that the petitioner is ready to deposit the aforesaid amount' be read as 'learned counsel for the petitioner submits that the petitioner is ready to deposit Rs.3,00,000/- in the Bank''.

In the same manner, the words appearing in fourth line from the top of page no.2 of the aforesaid order i.e. ' subject to the condition that she will deposit the aforesaid amount within eight weeks from today' be read as 'subject to the condition that she will deposit Rs. 3 lacs in the Bank within eight weeks from today and if she succeeds in the case, the Bank will return the aforesaid amount'.

Accordingly, the order dated 06.01.2021 stands modified to the aforesaid extent only.
