Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Pre Trial NDPS Case No. BRBU10P0002752023 arising out of Koransarai P.S. Case No. 08 of 2023 registered for the offence under Sections 8(c), 21(b) of NDPS Act 1985.

Allegation against the petitioner is that 8.5 Gram Heroine has been recovered from the possession of the petitioner.

No.25040 of 2023(2) dt.23-05-2023 2/2 Learned counsel for the petitioner submits that the petitioner is in custody since 05.02.2023 and the petitioner is quite innocent and he has been falsely implicated in this case. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering intermittent recovery of 8.5 Gram of Heroine, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet or after completing nine months in custody on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District Judge-cum-Special Court, NDPS Act, Buxar/concerned Court below in connection with Pre Trial N.D.P.S. Case No. BRBU10P0002752023 arising out of Koransarai P.S. Case No. 08 of 2023.
