JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 17-07-2015 No one appeared for the petitioner on and even today no one appears for the petitioner. Counsel for the Board is present. It appears that Janta Flat J 43 situated at AP Colony, Gaya was settled with the petitioner in 1980 on 90 years lease hold basis under hire purchase agreement by the Board. In paragraph 4 she states that till date she has paid Rs.23000/- to the Board still the flat has not been handed over to her. Counter affidavit has been filed by the Board. In paragraph 5 the Board states that a demand notice bearing Memo no. 886 dated 29.1.2011 along with a calculation chart amounting to Rs.96319.25 was due against the petitioner. Learned counsel for the Board further submits that in the light of order of the Hon'ble
Patna High Court CWJC No.12883 of 2012 (7) dt.17-07-2015 Court, a Pricing Committee has also been constituted for assessing revised cost for registration and handing over possession of such flats.
This writ petition is disposed of with direction to the petitioner to approach the Board authorities at Gaya with willingness to pay the up to date revised price of the flat, the latter would supply her a fresh demand notice along with a calculation chart. Thereupon, if the petitioner pays the up to date price, the Board would take steps for registration and handing over the possession of the flat to the petitioner. (Samarendra Pratap Singh, J) Shashi.
