The petitioners seek pre-arrest bail in connection with Complaint Case No.290 of 2017 registered for the offences under Sections 406, 323, 379, 504 and 506/34 of I.P.C. Accusation is that tha complainant Deepak Sah had given Rs.1,00,000/- to petitioners no.2 and 3 for constructing the house before 1 1⁄2 year which was to be returned within two months but they did not return the said amount and ultimately on intervention of well wishers the petitioners fixed the date 11.3.2017 to return Rs.50,000/-. But when the complainant reached at the house of
Patna High Court Cr.Misc. No.29043 of 2018 (2) dt.10-05-2018 2/2 the petitioners and made demand then he was refused and threatened by the petitioners for dire consequence. At that time petitioners snatched golden locket, cash and mobile set of the complainant.
Learned counsel appearing on behalf of the petitioners submits that, in fact, the complainant and the petitioners are relative and due to some dispute there, there is strained relation and due to that reason the complainant has filed the present Complaint Case No.290 of 2017 against the petitioners with the false allegation.
Having considered the facts and the circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the SubJudge - cum -Additional Chief Judicial Magistrate- III, Patna City, Patna, in Complaint Case No.290 of 2017subject to the conditions as laid down under Section 438(2) Cr.P.C.
