Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273, 420, 467 and 471 of the Indian Penal Code and section 30(a), 36, and 38 of Bihar Prohibition and Excise Act.

As per the prosecution case, on secret informant the informant intercepted a car and a motorcycle but one Bolero vehicle managed to escape. The apprehended persons disclosed the name of the co-accused as the driver of the Bolero vehicle

Patna High Court CR. MISC. No.24905 of 2022(2) dt.17-08-2022 2/3 loaded with liquor and informant recovered 264.930 litres of illicit liquor.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is accused in five other criminal cases out of which three cases are of similar nature. The petitioner are on bail on all aforesaid five cases. The petitioner is in custody since 24.01.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court No. 1, Muzaffarpur, in connection with Katra P.S. Case No. 184 of 2018, with a condition:-

1. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
