JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302/ 34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other FIR named accused persons assaulted and pressed the neck of husband of informant as a result whereof he died. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that specific accusation of pressing the neck is against other accused persons and so far petitioner is concerned only allegation against her is that she assaulted the deceased with wooden stick but no external or internal injury was found on the body of deceased. Petitioner has got clean

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner is named in the FIR and there is direct and specific allegation against her of assaulting the deceased with wooden stick. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
