ANJANA MISHRA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Complaint Case No. 293 of 2014 registered for the offences punishable under Sections 420 and 465 of the Indian Penal Code. Learned counsel for the petitioner submits that a fraud had been perpetuated in which the petitioner has no role to play. It is submitted that the husband of the complainant came to the petitioner for identification of his wife. The petitioner as Mukhiya was wholly unaware that Smt. Tara Devi (complainant) wife of Krishna Choudhary (husband of the complainant) had been separated and in fact the second wife who was presented by Krishna Choudhary was not the first wife. It is submitted that he was also

Having considered the entire facts and circumstances of the case and that at best the role that can be assigned of identify, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Ramesh Kumar, learned Judicial Magistrate, 1st Class, Gaya in connection with Complaint Case No. 293 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
