JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 188, 272, 273 and 34 of the Indian Penal Code read with Sections 30, 38, 41 and 66 of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.02.2022, charge-sheet has been submitted in the case and has antecedent of three cases. Allegation is of recovery of 176 litres of liquor from cartons.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and came to be implicated based on disclosure made by the local chowkidar

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.02.2022, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Janta Bazar P.S. Case No. 39 of 2018.
