SINHA ORAL JUDGMENT Date: 27-03-2015 Heard learned counsel for the petitioner and the State. Petitioner superannuated while serving as Electrical Executive Engineer with effect from 31.01.2002. He has filed this writ petition for a direction to release his entire retiral benefit as for the present he is getting only 90% pension, but gratuity and leave encashment have not been paid, as it is said that one vigilance case is pending against him.
It is submitted on behalf of the petitioner that in the said vigilance case besides the petitioner, other employees of the Successor Holding Company were also accused and those other
Patna High Court CWJC No.7198 of 2011 dt.27-03-2015 2/2 employees are being paid 100% pension, full gratuity and leave encashment. In this connection, petitioner has already filed representation dated 21.01.2009, Annexure-2 giving names of the other co-accused- employees in whose case 100% pension, full gratuity and leave encashment has been allowed. Let the Chairman of the Successor Holding Company again consider the aforesaid representation in accordance with law ignoring the order contained in Letter No. 238 dated 03.02.2011, Annexure-3 whereunder the said representation has been disposed of without taking into account the case of the other co-accusedemployees, who have been allowed the benefit of full pension and other retiral benefits.
Fresh order in the light of this order be passed by the Chairman of the Successor Holding Company within two months from the date of receipt/ production of a copy of this order. The writ petition is, accordingly, disposed of. (V.N. Sinha, J) Arjun/- U
