Petitioner seeks bail in a case registered for the offences punishable under Sections 326,307,427/302 of the Indian Penal Code and 27 of Arms Act.

As per FIR, the petitioner is also assailant of deceased Bambam Chaudhary @ Amit Chaudhary. Petitioner has got a list of criminal cases against him. Petitioner is in custody since 01.02.2015.

Considering the nature of allegation against the petitioner and his criminal antecedent, I am not inclined to enlarge him on bail in connection with S.T.No.297 of 2015 (Bihpur P.S.Case No.17 of 2015) pending in the court of learned 2nd Additional Sessions Judge, Naugachia (Bhagalpur). Hence,

Patna High Court CR. MISC. No.25606 of 2019(3) dt.11-06-2019 2/2 prayer is refused.

Learned Trial Court is directed to expedite the trial.

It appears that charges in the trial was framed on 20.02.2017 vide S.Tr. No.297 of 2015 pending before the then 3rd A.D.J., Naugachia (Bhagalpur), however, no prosecution witness has turned up till date.

The Superintendent of Police, Naugachia (Bhagalpur) shall ensure production of witnesses on day to day basis and the learned Trial Judge shall proceed with the trial without allowing long and unnecessary adjournments. The learned Sessions Judge, Bhagalpur shall monitor the matter.
