JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 366A,341 and 323 of the Indian Penal Code.

The prosecution case is that the FIR named accused persons came, abused and assaulted the informant. Co accused Ajay Kumar threatened to keep Nibha under control. It is further alleged that six months prior to the lodging of the case, the sister of the informant Nibha was enticed away by co accused Raj Kumar Yadav but after three-four days she returned home. Subsequently, on 9.10.2014 also the accused Raj Kumar again enticed Nibha when information was given to the police. The petitioners

Patna High Court Cr.Misc. No.41950 of 2015 (2) dt.13-10-2015 2/2 were not named in the FIR. In 164 Cr.P.C. statement the victim Nibha named the petitioners who facilitated the commission of the offence.

It is submitted by the learned counsel for the petitioners that the thrust of accusation is against the FIR named accused and other FIR named accused persons have been granted anticipatory bail vide Cr. Misc. No. 16848 of 2015.

Considering the fact that thrust of accusation is against the FIR named accused persons, the petitioners being ladies and Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Munger in connection with Kashimbazar P.S. Case No. 194 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
