The petitioners apprehend their arrest in Paharpur P.S. Case No. 199 of 2015 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named the petitioners along with one another person that they came to her house and assaulted the informant, her daughter, sister-in-law and other family members. Learned counsel for the petitioners submits that there is a counter version being Paharpur P.S. Case No. 200 of 2015 in which four persons are injured. The informant of the aforesaid case is petitioner no. 2 of the present case, but from perusal of the FIR and the case diary it appears that the petitioners are alleged to
Patna High Court Cr.Misc. No.29803 of 2016 (3) dt.10-11-2016 2/2 have assaulted the informant and four others out of which three persons got injuries on head and opinion with regard to their injuries are still kept reserved. The investigating officer has not obtained the injury report and the investigating officer asked the petitioner to appear before the court as the investigating officer did not require his custodial interrogation.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
