ANJANA MISHRA ORAL ORDER 29-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in Kawakole P.S. Case No. 29 of 2016, registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners were having a dispute with the informant side with regard to a small gali for which they had earlier lodged a case in the year 2015. It is further submitted that though the informant Rajo yadav got injuries on his head and arm, but the injuries are found to be simple in nature. The injury on his arm, though
Patna High Court Cr.Misc. No.30490 of 2016 (2) dt.29-08-2016 2/2 found to have grievous are not on vital part. Having heard the learned counsel for the petitioners and learned counsel for the State it appears that there is no allegation of commission of offence under Section 307.
Considering the facts and circumstances and also that the petitioners are not having criminal antecedent, let the petitioners in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Nawada in connection with Kawakole P.S. Case No. 29 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
