The petitioner is apprehending his arrest in connection with Sultanganj P.S.Case No.73 of 2015, registered for offences punishable under Sections 354 and 509 of the Indian Penal Code. Allegation against the petitioner is of creating obscene picture of the daughter of the informant and also threatening him. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and the witnesses has not supported the case during the course of investigation. Heard learned A.P.P. also.
Having heard both sides and considering the allegation that this is not a case for grant of anticipatory bail, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is
Patna High Court Cr.Misc. No.33691 of 2017 (2) dt.20-07-2017 2/2 directed to surrender before the learned court below within a period of four weeks and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
